Posting Another Person's Blog Content

Posting Another Person's Blog Content

Hello,
I am curious to know what consequences, if any, there would be for posting the content of another person's blog verbatim on my own site. Whether it makes a difference if the screen shot image files, or the actual text is cited.

The blog was public and has since been removed. It would not result in profit, it would reside on a site with no adds or other content.

I'm especially curious if posting something publicly on the internet for years and then removing it gives you any right to privacy.

Thank you for your time, please let me know if more details would help to clarify my question!

Re: Posting Another Person's Blog Content

I cannot give you any specific legal advice, but I can tell you that each time that you publish something online, you expose yourself to potential legal liability. For example, if you post another person's blog content without his/her permission, you may open yourself up to legal liability for copyright infringement.

Generally, posting another person's blog content should not constitute a claim for publication of private facts because the law protects you if you publish information already exposed to the public eye. Ordinarily, publication of information on a blog (or any other publicly available platform on the Internet) will satisfy this element.

For more information on the potential legal liabilities associated with publishing the content of others, see the Risks Associated with Publishing section of the CMLP's Legal Guide.

Copyright navigation in the blogosphere

I am unsure as to whether this will still be useful given the age of this post, but EFF has an outstanding guide to help bloggers navigate sticky copyright issues, which generally turn on context specific aspects: http://www.eff.org/issues/bloggers/legal - the liability section is linked at the bottom of the page.

I found this while doing research for setting up my own blog, www.allmediaLP.com - where I will be posting articles relevant to issues like this.

Thank you! Still relevant,

Thank you!
Still relevant, and happy for the new post!

Re: Posting Another Person's Blog Content

As far as I know, you are legally free to do so, as long as there are certain rules you follow:

1) Give credit to the original author, and clearly state the purpose of reposting the material.

2) If asked by the original author to take the material down, TAKE IT DOWN.

3) Be absolutely certain that you do not modify the content in any way, shape, or form.

4) Include a disclaimer that states the fact that you do not profit from the reposting of this material, just in case (this is not a legal requirement, but is helpful in protecting you from self-appointed vigilantes).

5) Use a free service to host all of it, such as Wordpress or Blogger, in order to maximize accessibility. That way, you can't be accused of seeking profit.

Re: Posting Another Person's Blog Content

I am not sure about this but I think posting another person's blog content is somewhat like a plagiarism, unless if you have proper citations, give credit to the original author and clearly state the purpose of re-posting the material.
