My company performed work for an individual last year. They refused to pay us saying our work was unsatisfactory. We sued in small claims court and won the full amount due plus costs. He tried to file an appeal a day too late but it was denied. He then proposed a settlement offering to pay us if we did more work for him and if he was fully satisfied after providing that work!
He has now created a website dedicated to defaming my company. I would like to file a defamation suit.
1. Where can I file this? My company is based in San Diego County, he is based in Los Angeles County?
2. What court do I file this with? Small claims?
3. The website clearly defames my company, so do I need to show actual damages?
