Federal Magistrate Recommendation
By order of Federal Magistrate Judge Roann Mann, the plaintiff's lawsuit is recommended dismissed with the quashing of the arrest warrant and restraining orders including dismissal of the $5 million award.
The New York State Judge, His Honor Judge Schack did not have jurisdiction to issue any orders, having conducted no jurisdictional analysis prior to making his rulings.
Parties are provided until September 26, 2011 to object to the recommendation, whereupon Federal Judge Deary will issue a final ruling.

Final Ruling
Federal Judge R Dearie ruled after an objection to the magistrate judge's R&R was filed by Senese on September 26th. The case has been dismissed for lack of jurisdiction and the restraining order, order for contempt and warrant for defendant Hindle's arrest have been quashed.
The case is now closed.
